Lexington Park Man Jailed for Failure to Pay Child Support

Late last week, a judge ordered that a man from Lexington Park be held without bail after he had failed to pay child support.  According to reports, the man, named Deodis Lee Clyburn Sr., had four child support cases filed against him beginning in 1994.  It was estimated that the Clyburn had an unpaid balance of $98,629.

The total was derived from information collected in 2007 when a body attachment was issued for the defendant's arrest. 

During a bond hearing, Circuit Court Judge C. Clarke Raley asked Clyburn if the total of reported unpaid child support was correct.  Clyburn responded, "I mean, I guess, your honor."

At this time, Clyburn is waiting for a public defender to be appointed to his cases.  Judge Raley ordered that the four cases be scheduled before a judge that handles family law matters.

He also said that due to the outrageous amount of unpaid child support, no bond would be issued for Clyburn.

Lindsay Lohan's Dad Owes $15,000 in Child Support

According to several media outlets, Lindsay Lohan's father owes $15,000 in unpaid child support to his ex-wife, Dina Lohan.  News sources say that Michael Lohan is very behind on payments for three of his younger children.

According to legal documents obtained by reporters, Mr. Lohan has not paid child support for his children Aliana, Michael Jr. and Dakota Lohan.

Last week, it is reported that Michael Lohan sold audio tapes of his family to the press for money, which prompted his famous daughter to retaliate.  When paparazzi hounded her, she said, "Why don't you go and find my dad? He's the one who wants the pictures."

On the tapes sold to the media, Dina tells Michael that their daughter Lindsay is "drinking again".  However, there is no way to tell when the tapes were made.  Dina said that the tapes had been recorded before Lindsay went to rehab for treatment.

Child Support Amnesty Program Launched in Clark County, NV

Parents facing legal repercussions after failing behind on their child support payments have been given a chance to catch back up.

The Clark County, Nevada District Attorney's office has launched "home for the holidays," an amnesty program created to recover outstanding child support payments.

The program is being offered to noncustodial parents whose driver's licenses have been suspended and/or have a child support warrant issued in their name. Those who participate in the program will meet with a case manager to negotiate a one-time payment.  After the payment has been made, all warrants will be eliminated and driving privileges will be reinstated.

The program begins today and runs through November 21.

Clark County District Attorney David Roger hopes the program will help parents resolve their support issues so they can spend time with their families over the holidays without worrying about being arrested and incarcerated.

New Law Puts Gambling Winnings Towards Unpaid Child Support

A new Colorado law has helped the state recover more than $600,000 in unpaid child support.

The law requires casinos to conduct a computer check if a person wins over $1,200.  If the computer database indicates that the person is delinquent in paying child support, the winnings are used to pay back the support he or she owes.

Although the $600,000 that has been recovered in casinos is a small amount compared to the other $320 million that was collected, it proves the law is working.

In Denver County, $64,381 was collected in 2008 and $83, 268 has been collected so far this year from gambling alone.  In addition, Jefferson County has collected nearly $34,000 from casino winnings this year.

While advocates praise the law as a viable way to get money from deadbeat parents, casino owners are not as enthused, saying the law is difficult to enforce and that patrons get angry when they find out their winnings are being taken by the state.

"Why single out the casino industry to be the state's bill collector?" said John Bohannon, general manager of the Isle Casino Hotel in Black Hawk.

Colorado is one of only a few states with a child support law like this, and was the first state in the country to pass such a law.

21 Arrested in Oregon for Unpaid Child Support

In Portland, Oregon, 21 people were arrested after the state conducted a sweep to find unpaid child support offenders.

According to Oregon's attorney general's office, parents were arrested this past Wednesday.  The combined amount the parents owed in delinquent child support was $530,000.  They also claim that most parents in Oregon make their child support payments.  Last year, the state received $344 million for over 250,000 children.

The sweep was spearheaded by an Oregon Department of Justice task force.  Included were district attorneys and over 30 law enforcement agencies from throughout the state.  The task force arrested individuals who had outstanding contempt complaints for willful failure to pay court-ordered child support.  Each offender is facing a maximum sentence of up to 6 months in jail and large monetary fines.

Tennessee Court to Hear 700 Child Support Cases in One Week

In Memphis, Tennessee, the child support division of the Shelby County Juvenile Court is expected to be extremely busy the last week of this year.  In years prior, the child support division would not hear cases over the holidays.  However, this year, the Court will be hearing cases next week due to an increase in reported unpaid child support incidents.  Child Support Services Director, Mitch Morgan, reports that the Court will hear between 700 - 1,000 child support cases next week alone.

According to Morgan, child support collections have been up since July.  Unpaid child support is up by $7 million from the same time period last year and collections have increased by 20%.  And, despite the increase in collections, parents throughout Memphis are still owed $670 million in unpaid child support.

Some parents who owe child support have been identified in local papers because the amounts are so outrageous.  For example, Winston Rogers, a Memphis rapper, owes over $230,000 in unpaid child support.  Leeanthony Hamilton owes just over $40,000 and William Brents owes $167,000 in unpaid support.

In 2007, only 5,000 new child support cases were filed.  In 2008, that number reached 16,000 cases, all of which have been entered into the court.  Due to the increase in cases, Morgan had to hire 40 new staff members, including 8 child support enforcement attorneys.  Cases are expected to heard and resolved next week.

This past Thursday, former Texas professional baseball player, Troy Neel was arrested by authorities after he failed to make over $724,000 in child support payments.  Neel was arrested in Los Angeles on both state and federal charges for unpaid child support.

In the 1990s, Neel was a professional baseball player for Oakland Athletics.  He played for Oakland throughout the early 90s and then for several professional teams in Japan until 2000. 

According to Travis County Court legal documents, Neel was ordered to pay his ex-wife $5,000 a month in child support for his two children after he obtained a divorce.

In the beginning, Neel was able to make the payments, but then he came into tough financial times and was unable to continue making ordered payments.  He wrote the Attorney General and asked for help.  According to Neel's defense attorney, James Sustaita, Neel, "told the Texas Attorney General's Office that the amount of child support ordered to pay was just impossible.  He couldn't afford it."

Neel claims that he was only able to make partial child support payments. At this time, he owes the balance of unpaid support and a 12 percent interest charge that will continue to grow.    The interest alone amounts to $2,600 to $2,700 a month.  Neel told reporters that he loves both of his children and he is trying to do the right thing.

However, the Attorney General's office begs to differ with Neel, and has even posted pictures of Neel's private South Pacific resort on its website.  Neel and his attorneys have countered the Attorney General office's speculation by saying that Neel no longer owns the resort.

The family law attorneys representing Neel have filed a motion in Travis County to have the monthly child support payments lowered.  They argue that the payments should have been lowered years ago.

At this time, Neel remains in police custody in Los Angeles.  He will be brought to Texas to face both civil and criminal charges related to his $724,000 in unpaid child support.
